APRIL 12,2010 MONTHLY MEETING REPORT
INTERNATIONAL DECISION POSSIBLE THIS WEEK..
President Weir indicated that the UBC International might be deciding the fate of the Empire Council this week. He based this on the Executive Board meetings being held this week in Vegas and the fact that it has been almost two weeks since the hearings. It seems supervision is a foregone conclusion.
One scenario is that the EST would be fired and replaced. This did not appear to be very believable to Weir. Another is that others would be fired as well as Morin. Finally it is possible that all would be fired and they would start over. What ever is decided lets hope the guilty parties are rooted out and fired. Lets hope they are not replaced with more of the same.
$6.4 million reallocated??At our local 370 meeting this evening President Weir informed the membership that the $6.4 million in fund money that was given to JP Jeanerette in December 2008 under suspicious circumstances was reallocated . Mr. Weir claimed that this plan was already in the works before the hearings. It is rather odd that Mr. Morin under enormous pressure during the hearings did not announce this PLAN in his defense. Weir admitted this could be irrelevant if the International decides to further their plan for an more equal allocation. Mr.Weir indicated that it was decided for the fund to absorb this $6.4 Million loss. We shall see the truth shortly.
Morin a no show..It was confirmed that Patrick Morin was a no show at the April 6,2010 Empire Council E Board Meeting. It has been rumored that Morin has not been in his office since the hearings. This was not confirmed at our meeting and Weir said Morin has not been officially removed yet.
Cutting Up Your Raises. It appears they are already making plans for the next raise. Nothing has been decided according to Weir but they are looking for money in the Apprenticeship and Pension funds. Weir claims our health fund is fine. Weir claims the AGC is blasting us and negotiating with them on the heavy highway wont be easy wont be easy. It was announced that Local 370 was going to have to pay for a copy of the hearing transcript from the UBC International and Weir asked for approval for the expenditure. Is this a joke. How much do we have to pay in Per Capita Tax to the UBC each year. So if we want a copy of the Hearings which will have a direct impact on our future the UBC is going to extort more money from the Locals. Perhaps the UBC could have skipped the set up for breakfast, lunch and dinner for 141 people at the Crowne Plaza and given us free transcripts instead.
Weir appears to believe his days might be numbered..President Weir may be accepting the writing on the wall. During a number of exchanges Mr. Weir gave the impression hat he may not be around for much longer and is taking a wait and see attitude before agreeing to commit to anything. It was suggested that the Local 370 Pension Fund take steps to protect itself from ever being taken by the Empire Council and to remove the burden of the Council ESTs control over our Fund. While Mr. Weir agreed it would not be in the best interest of the membership for the Empire Council to EVER take our Pension fund Mr. Weir refused to commit to taking any steps to prevent it. He kept repeating that he could possibly not be around and that others should make such moves. Mr. Blacklock was asked to step up and he ignored the question in his usual "how dare you question us" posture. At least we did not have to listen to Blacklock tell us his patented "I don't Know but I will get back to you. Does Weir know something we don't. Is he on his way out.

Patrick Morin has not been removed as a trustee of the Local 370 Fund. Why not. There has been no action taken to secure our pension fund from future Empire Council raid attempts. The UBC International has handed our seated trustees a golden opportunity to rid itself of the burden of the Empire Council and future Council EST controls and they are letting it pass them by. WHY!!!
The UBC International has indicated that the claim of Patrick Morin to rule all funds as lord and master has holes in it. Morin as did Fuchs and Simmons before him has claimed that the CBA and Empire Council Bylaws allows him to seat and remove fund trustees and to allocate and reallocate funds as he sees fit. The UBC International has challenged that position which opens the door for our fund trustees to take action. Will the fund trustees take action and if not lets examine why not.
Trustee Pinchook is quite aware that the Empire Council BY Laws and the CBA do NOT supersede the Plan documents and Trust agreements. Mr.Pinchook was a defendant when the Federal Court told John Fuchs to stick it in his ass when he tried to seat himself as a fund trustee and remove Phil Allen so he could stack the votes to steal the Adirondack and 229 funds. The Judge ruled that the Council Bylaws do not supersede the plan documents and after two years in court and hundreds of thousands spent the judge sent Fuchs and his cronies packing. Ronald Kent is quite aware of this as well since he was a rat for the Empire Council who along with Terry Middleton and Lenny Osborn sold out the members of 229. Ronald Kent is named as a plaintiff in the case.
The only reason Morin has got away with this is because our trustees have conspired with Morin and the Empire Council to screw the very members they have a due diligence and fiduciary duty to protect. They could have and can now remove Morin and the Empire Council control but have chosen not too. Why?? We can understand Weir, Blacklock and Kent. They are yes men and shills for the Empire Council who are not going to risk the council paycheck regardless of how many members they have to sell out. Caropresso is blatantly obvious as well. He is a trustee on so many funds across the state one has a hard time keeping track. He has his nose imbedded in Morin's ass and is a Empire Council lackey. Or is it the other way around. I wonder exactly what company he owns and runs to qualify him to be an Employer Trustee. Sorry Tony but I COULD CARE LESS about the Eastern Contractors Association and I don't believe it qualifies you to be an employer trustee. How many years have you held a Local 370 Union book?? How many years have you been in our Local 370 Pension Fund??Lets hope when the dust clears the International turns it attention to you with the intent to send your ass packing. But why the others. Rosch, Curran and especially Pinchook. Pinchook has fought long and hard for the members of 229. Curran I do not know. Why are they not standing up to this corruption.

The Trustees have been handed a silver platter. The Trust Agreement and Plan Document can be amended to prevent any future Council EST from removing and seating trustees. Wording can be included, as it was in the Adirondack fund, which would prevent some greedy clown like Fuchs or Morin from seating others or themselves as trustees to stack the deck. This must be done and be done now to prevent them from making any future attacks against our fund. This must be done now to put an end to this $30 a credited year sham of a Pension fund forced on us by Morin and his council cronies.
For our Pension Fund to survive the trustees must act know. Morin's pocket pals and Council cronies Weir, Blacklock and Caropresso must be sent packing. Its time for the Trustees to serve the membership. Give it some thought boys. Morin is history and Weir is not far behind him. Blacklock can never survive his ambitions. He has neither the IQ nor the personality required to fill even such tiny shoes as William Weirs. Its time for accountability for those trustees that sold our Health, Annuity and Vacation fund down the river. It time for accountability from those trustees who allowed Morin to stick us with this $30 a credited year fiasco. Its time for the seated trustees to act NOW to save our Pension from ever falling onto the hands of the Empire Council and the next greedy little EST.
